It's shit like this ^^^^ Which is why I wouldn't be torn over eventually exiting the custom spraying game. I'm insured and everything, but this day and age an insurance company has no problem leaving you in the dust.


I've had drift cases, accidental spraying cases ranging from a few feet over a property line to spraying the entirely wrong field and I even 1 time had an intentional spraying of a neighbors ground after a dispute.

All of those were in Kansas and under the old system of damages. I can't even imagine what some of those would have been using this new ruling. I anticipate some YUGE lawsuits coming down the line for drift hitting organic cropland because they could argue that ground will take several years to return to the "organic" certified level they were at prior.

PS: Negligence is covered by insurance but intentional torts (doing it on purpose) are never covered by insurance. My case with the fighting neighbors my the client intentionally sprayed and we settled because the other side knew there wasn't some endless deep pocket book of insurance to go after and my client's $40,000 offer was the best he could get. The Kansas case that just got affirmed by the court of appeals is an intentional case (conversion) so the farmer's insurance won't be covering any of it... he has to pay the $1.2m all by himself.


Here is what every future defense lawyer in KS is gonna say with intentional spraying cases or no insurance defendants
