@Daddy as with most franchises that already have locations in the area there is a very likely chance the rights to any future flags in the area are already owned by somebody. The rights to franchise are typically long term option contracts. (deal with it all the time in Hotels) Often times the rights holder has a period of years where they have to build (commit) or they lose their rights in the flag and then corporate will sell them again. You can find out who the current owner is and buy it from them or form a partnership, or just wait for the option to sunset and get it from corporate.
Also you have to consider the exclusivity zone rights that come with the franchise. Example: can't be another Hampton for a 2 mile radius around my property. I assume JJ's would be similar so you would need to check distance to another franchise.
**Be Aware** You might also run into rights owners who have no intention on developing, they just want to restrict the market. Usually they own other businesses and don't want it cannibalized. I have found these rights owners typically refuse to sell and you have to wait for their option to sunset. On the inverse, I have found owners who simply don't have the capital to develop are typically willing to sell. They fully planned on developing but something happened and yada yada yada just haven't been able to do it yet/can't do it anymore.
PS: You want my free advice? If you're gonna try and bring a franchise to a city like Lincoln (tons of franchises) get something thats not there yet. (especially if its food) Example: for the life of me I don't understand why there isn't a Waffle House somewhere close to Downtown Lincoln. Low overhead, tons of cash flow.
