Correct. Don't have to pay out capital gains.
NICE!! I’ve been putting spare $$ into some stocks for quite a few years to build it up so I can buy my uncle out from the farm when he’s ready. Now my problem is going to be capital gains tax on them especially on my caterpillar stock when that time comes. There’s just no legal way that I’m aware of to defer or avoid those taxes like there is on farm ground if you swap acres (10-31). I don’t mind paying SOME taxes because that means I’ve made money but damn they make it hard sometimes.

You still pay capital gains tax when you sell ETF's. What I was referring to was mutual funds have to distribute capital gains (like dividends) every year. ETF's do not.

And no there is no legal way to defer those gains short of not actually selling them.

Do a land contract with uncle so you can cash out slowly. Especially if you would inherit the land from him.
