He walked into his Mom's house after her burial to find his nephew banging his GF (both just turned 18 years old) on the couch after they skipped the funeral.
Defendant tells nephew what a piece of shit he was for missing his grandma's funeral and now having sex in her living room like its a frat house.
Defendant tells nephew that if his Dad (older brother to defendant) was still alive he would have beat his ass for it.
Nephew runs his mouth to Defendant.... Defendant walks over and grabs nephew by the hair and smashes his face.
Had he stopped after a punch or 2 the cops would have probably not sent over a referral for charges OR they would have sent the referral to the prosecutor with a sticky note saying something like: "if you don't file this we get it" (AKA code for don't file this we just sent it over to cover our ass)
I got brought up to prosecute the case cuz the slutty GF/only non-party witnesses was somehow related to multiple people at the Lincoln County Attorney's office and they thought it would be best to avoid a conflict and bring in somebody to prosecute the case.
I let him plead down to a Misdemeanor Domestic instead of the Felony so all he had to do was 2 years of probation and still had voting/firearm rights. The nephew was such a shit head. (asshole to cops and asshole in the court room) Should have just stopped at 1 or 2 punches.... smh
PS: if anybody is a resident of Lincoln County or the surrounding area if you ever see a woman with the name Angela Franz on a ballot vote for her she is a badass. She is currently the Deputy County Attorney in Lincoln County that mostly handles assaults and sex crimes and I would assume by next election cycle she is either gonna get poached by another County or the Attorney Generals Office.
