I know. Just fucking amazing. An all-time bungle of a situation involving the Great Bungler. I just can't help but appreciate the hilarious poetic justice of the situation. I can't wait to read what he has to say when he finally has the green light because you know he's going to get absolutely roasted by the board for the rocky transition, his fault or not.

I'd have to imagine the publishing contract with Rivals would include some sort of non-compete provision. However, what's puzzling to me is that any such provision, along with the termination date of the overall contract, would have to be among the very first things both Callahan's and On3's lawyers would have examined in setting up this deal. Given that it's clearly been in the works for at least almost a year (see, e.g., Callahan's join date when you look at his profile there), I'm hard-pressed to come up with a plausible reason how they could have missed something that should really hold up this transition.

Unless I'm just not thinking of something more sensible, the options appear to be:

1) Both Callahan's and On3's attorneys missed something that truly is a snag and they should all probably be fired;

2) Rivals is making a frivolous or near-frivolous argument that On3 is not budging on and will require some form of dispute resolution (litigation, arbitration, mediation); or

3) #2 but the parties are quickly working out some sort of final settlement that includes mutual releases.

Interesting thing is that like 10 or so other Rivals dudes made their move over to On3 and they presumably had no trouble make their transition.

The HOL/RSS one seemed to surprise the On3 staff so something must have really been misjudged. I have to think it's because Dean is clinging so tightly to the HOL/RSS names. I'm guessing that the other defectors just gave up their Rivals site name and made a clean break to On3. Dean for some reason thinks the HOL name has this high value and I don't really see why.

He should have just rebranded completely and made the smooth transition. No one gives a shit about the HOL name. I guarantee you that HOL name is not worth whatever legal fee $$$ he's spending right now fighting Rivals. Most people don't even know it was called HOL, they just knew it as the Nebraska/Rivals site.

Dean posted something in the last day or two where he was talking about how valuable the HOL brand is. That may have been in one or the blurbs he had to delete. So I'm speculating that the HOL name was probably a much bigger deal to him than the other names were to the other Rivals defectors. A new name would have actually been better for him as they would have had a chance to do a clean restart and build up a new brand with some new faces (Sipple).

Honestly, I wouldn't have even known it was called HOL without the emails I get every time my monthly payment went through. I just knew it as the Nebraska Rivals site.

If that's what is holding it up, Dean is clearly clinging to sentimentality. His value is in the 10,000s of subscribers he has. 75% of which probably don't even know the name of the site (HOL). Seems an unnecessary hill to die on especially when "the launch" was so important, etc. Now they have like the biggest recruiting weekend ever coming up and they may have no one to write content for it. Oops.

I imagine most of you are like me, the product on the field has been so bad for 8 years that I just don’t give a fuck about recruiting or day to day stuff with our teams anymore.

Only reason I kept rivals was for the RSS which went down sharply over the last few years and for the main board which fell of a cliff and is a shell of its gypsies/mail order bride/queen Elizabeth vs fat wade glory days. My sub runs out in a couple weeks over there and I won’t reup, I have little faith in the tMB getting funny again or the new outsider and less than PT Nate Clouse making husker rivals site good.

With On3 being a 1$ for a year I’ll give it a chance, don’t have high hopes given it’s the same guys that ran RSS into the ground.

Thank god we have tPB otherwise I’d be off message boards all together at this point
