Has anyone ever done a diminished value claim after a car accident before? Last month I was driving my 3 week old car up to golf with @lee_carvallo_12 when a 25 year old kid hit me. He said he was "swerving through traffic trying to get home quicker."

His insurance obviously is paying for all of the repairs, but I was told I should go after his insurance (Progressive) for a diminished value check as well. I talked to them today about it and they said that "when it's repaired it's back to its original value" and I said absolutely not. It was 3 weeks old and now it has been in a wreck, I will be upside down on it forever.

I'm thinking I will get some documentation from the dealer about how much it was worth pre and post accident, but didn't know if anyone has ever dealt with this and how I can get as much money as possible from them.

Yeah, IDK about all that. I would think this only applies (diminished value compensation) when the vehicle is in its 1st year or 2 of life? Maybe even the 1st six months? But it makes sense.

Insurance companies fucking suck. You better not miss a damn payment, but when the time comes for them to pay… Yeah, we’ve all been there.
 
I have not heard of this before but it makes total sense. I would probably hold out for a 7 figure settlement.

Ok, I looked up some Colorado specific info some I've never dealt with that state.

They definitely owe diminished value. A DV claim puts the burden of proof on you, so you need to provide as much documentation as possible. Getting an appraisal from a dealership would be a good start. If you can find comparable sales that helps. This will be highly dependent on how much the repairs cost. Start high so you have room to negotiate

They also owe you loss of use, so if they didn't provide you with a rental they would owe the going rate to rent a comparable vehicle for the time your car was undrivable or undergoing repairs.

I’ve tried to find some comparable ones for sale but finding a 2025 with only 1k miles on it and already been in an accident is basically impossible.

They did give me a rental so all good there

I’ve done diminished value before through my insurance. Pretty easy process. Think there was some sort of catch, but decided it was still worth it.

The claim is legit.

Regardless of the damage and subsequent repairs, should you decide to sell or trade the vehicle, it’s value is lessened. As you’re finding out, establishing the loss in value isn’t always easy.
